In the matter of: Petition of Receivers of Ann Arbor Railroad Company for abandonment of Trains Nos. 51 and 52, between Toledo and Frankfort. D-3351. March 3, 1943.

On the 26th day of August, 1941, the Ann Arbor Railroad Company, by and through its receivers, Norman B. Pitcairn and Frank C. Nicodemus, Jr., filed with this Commission a petition for permission to dis continue passenger service and to abandon, at all points on the line of its railroad, depots, depot buildings, and parts thereof, insofar as they are used, for the accommodation of passengers, for the sale of tickets for the transportation of passengers, and for checking the baggage of passengers; which petition was duly noticed and, on the 6th and 7th days of October, 1941, hearings were held.

On the 10th day of February, 1942, the Ann Arbor Railroad Company through V. Parvin, its General Superintendent, verbally requested the Commission to grant a continuance of its petition to the 1st day of September, 1942. Therefore, on the 10th day of February, 1942, the Commission issued the following order:

IT IS ORDERED that all proceedings under the petition of the Ann Arbor Railroad Company, first above described, be, and the same hereby are, continued to the first day of September, 1942; and “

IT IS ORDERED that the Ann Arbor Railroad Company, by and through its trustees, keep, or cause to be kept, proper records of any and all revenues received and expenses incurred by its continuance of said passenger service through the 31st day of July, 1942; and “

IT IS ORDERED that the Ann Arbor Railroad Company, by and through its trustees, prepare, or cause to be prepared, proper exhibits from its accounting records, showing any and all revenues received and expenses incurred by its continuance of said passenger service through July 31, 1942; and “

IT IS ORDERED that two sets of said exhibits be filed with this Commission on or before the 15th day of August, 1942.”

Under date of August 12, 1942, the Commission received the following letter from the Ann Arbor Railroad Company by its General Superintendent, V. Parvin :

Referring to the Order of the Commission, File No. D-3351 of February 10th, 1942, continuing the petition of the Ann Arbor Rail road Company for permission to discontinue passenger train service, etc., to September 1st, 1942.

We hereby request a continuance of this case to March 1st, 1943, and our reasons for so doing are as outlined in the Commission's Order of February 10th, 1942 herein referred to.”

Therefore, on the 14th day of August, 1942, the Commission issued the following order:

IT IS ORDERED that all proceedings under the petition of the Ann Arbor Railroad Company, first above described, be, and the same hereby are, continued to the second day of March, 1943 ; and

IT IS ORDED that the Ann Arbor Railroad Company, by and through its trustees, keep, or cause to be kept, proper records of any and all revenue received and expenses incurred by its continuance of said passenger service through the 31st day of January, 1943; and

IT IS ORDERED that the Ann Arbor Railroad Company, by and through its trustees, prepare, or cause to be prepared, proper exhibits from its accounting records, showing any and all revenues received and expenses incurred by its continuance of said passenger service through January 31, 1943; and

IT IS ORDERED that two sets of said exhibits be filed with this Commission on or before the 15th day of February, 1943

This order supersedes and makes null and void the Commission's Order No. D-3351 dated February 10, 1942.”

The Commission is now in receipt of a verbal request from the attorneys of the Ann Arbor Railroad Company wherein they ask that the above entitled case be continued for a period of one year. The Commission is of the opinion that the railroad company’s request is made in the public interest and that such interest will be furthered by granting such request; accordingly,

IT IS ORDERED that all proceedings under the petition of the Ann Arbor Railroad Company, as above described, be, and the same hereby are, continued to the second day of March, 1944; and

IT IS ORDERED that the Ann Arbor Railroad Company, by and through its trustees, keep, or cause to be kept, proper records of any and all revenue received and expenses incurred by its continuance of said pas senger service through the 31st day of January, 1944; and

IT IS ORDERED that the Ann Arbor Railroad Company, by and through its trustees, prepare, or cause to be prepared, proper exhibits from its accounting records, showing any and all revenues received and expenses incurred by its continuance of said passenger service through January 31, 1944; and

IT IS ORDERED that two sets of said exhibits be filed with this Commission on or before the 15th day of February, 1944

This order supersedes the Commission's orders No. D-3351 dated February 10, 1942 and August 14, 1942. -

MICHIGAN PUBLIC SERVICE COMMISSION.

In the matter of the application of the Grand Trunk Western Railroad Company for permission to discontinue and remove the interlocking facilities at the crossing of its Mine Spur Track and the tracks of the Ann Arbor Railroad Company located at Corunna, Michigan. File 943-141. June 23, 1943

Application was filed on June 14, 1943, by the Grand Trunk Western Railroad Company through its signal engineer, W. L. Dayton, requesting permission to discontinue and remove the interlocking facilities as now maintained at their Mine Spur crossing of the tracks of the Ann Arbor Railroad Company located at Corunna, Michigan.

Attached to said application is Grand Trunk Western Railroad Signal Department Blue Print Plan J.N.L No. W-1020.T.P. Issue No. 1, dated November 19, 1930 as revised July 24, 1941, showing in red the interlocking facilities at said crossing that is proposed to be discontinued and removed, which plan has been approved by W. L. Dayton, Signal Engineer for the Grand Trunk Western Railroad Company and by G. A. Rodger, Signal Engineer for the Ann Arbor Railroad Company.

In said application, the Commission is advised that the Grand Trunk Western Railroad Company has abandoned their Mine Spur track and crossing of the Ann Arbor Railroad tracks and therefore the interlocking facilities at the crossing are no longer necessary, hence the request for permission to discontinue and remove the interlocking facilities at that crossing.

The Commission, after due consideration of the application and plan, and after being advised that there is no objection on the part of the Ann Arbor Railroad to the proposed discontinuance and removal of said interlocking facilities at that crossing, FINDS AND HOLDS: That said Mine Spur track and crossing abandonment obviates the necessity of the further maintenance and operation of the interlocking facilities at the crossing and therefore said application should be granted and said plan approved.

THEREFORE, IT IS HEREBY ORDERED by the Michigan Public Service Commission that permission shall be and hereby is granted to the Grand Trunk Western Railroad Company and the Ann Arbor Railroad Company to discontinue and remove the interlocking facilities as now maintained at the crossing of the Mine Spur track and the tracks of the Ann Arbor Railroad Company located at Corunna, Michigan, and

IT Is FURTHER ORDERED that said Grand Trunk Western Railroad Signal Department Blue Print Plan JNL No. W-1020-T.P. Issue No. 1 dated November 19, 1930, as revised July 24, 1941, and approved by W. L. Dayton, Signal Engineer for the Grand Trunk Western Railroad Company, and by G. A. Rodger, Signal Engineer for the Ann Arbor Railroad Company, showing in red proposed abandonment of the interlocking facilities at said crossing shall be and the same is hereby approved and a copy of the same filed in the office of the Michigan Public Service Commission as File No. 943-141, and

IT IS FURTHER ORDERED that all prior orders of this Commission having to do with the above entitled matter and especially the Commission's No. 943-141 of Sept. 8, 1941, are hereby canceled and made void upon the fulfillment of the provisions of this order
